Boys placed under judicial probation; uncle meted 10-year jail term

  DUBAI – Two teenage brothers have been placed by the Dubai Juveniles Court under judicial probation after they were found guilty of having consensual sex with a 16-year-old Egyptian girl who claimed she was abducted and raped by the siblings and their uncle in February last year. The boys' 31-year-old uncle, on the other hand, was convicted by the Dubai Court of First Instance and sentenced to 10 years in jail. The boys – aged 14 and 15 - and their uncles were initiallly charged with rape before the Juveniles Court and the Dubai Court of First Instance, respectively, after the girl claimed that she was lured by the two teenagers and their uncle to go on a drive with them in exchange for an iPhone. The victim alleged that when they reached a deserted area, the boys and their uncle took turns in raping her. The boys and their uncle denied the accusations of the girl and pleaded not guilty. The Juveniles Court decided last November to put the boys under judicial probation for having while the Court of First Instance meted the prison sentence on their uncle. Prosecutors filed an appeal of the juveniles court decision before the Dubai Appeal Court to have the boys sent to prison. During the hearing on the appeal filed by prosecutors, the teenagers' lawyer Hamda Makki said the complainant lied about being kidnapped and raped by his clients and their uncle. "She joined my clients in their car willingly. She was not kidnapped, she also had consensual sex with them and was not forced to (it). Actually, the girl asked my clients to give her an iPhone and pay her money to go out with them. She had also been in contact with the suspects on WhatsApp," Makki said. But the girl said she was forced into a car by the defendants, to which Makki said: "Had the girl been forced to ride the suspects' car, then why didn't she cry for help and try to run away since she was in a crowded area? She had agreed in advance to meet my clients at 4.30 p.m. that day, she jumped into their car at her own will. The girl also testified in court that she had requested an iPhone to meet the suspects, this is a proof that she went with them willingly. The forensic report confirmed that there were no bruises or injuries on her body, the fact which eliminates her claims that she had been raped. She had also told the uncle that it was her father who had raped her and made her lose her virginity, she also had claimed to the suspects that she was used to having sex with men for money."
