An Abu Dhabi court has upheld a ruling awarding Dh350,000 in compensation to a father whose son was subjected to a medical error during a vaccination procedure in Al Ain. The case was filed against a hospital and a doctor after the father alleged the vaccine was administered incorrectly, though it did not cause permanent disability. The Medical Liability Committee confirmed a minor medical error, and the Court of First Instance initially awarded Dh300,000 in damages. Following an appeal, the Court of Appeal increased the award to Dh350,000. A final appeal by the doctor and hospital was rejected by the Court of Cassation, which ruled that disputes involving insurance coverage must first go through the Insurance Dispute Resolution Committee. The court emphasized that hospitals are liable for the actions of their employees, citing the Civil Transactions Law. Doctors are accountable if they fail to exercise “necessary care”—defined as the diligence of a reasonably skilled professional under similar circumstances. The ruling held both the doctor and hospital jointly responsible for the compensation.
