Abu Dhabi: Court dismisses case of a woman seeking Dh60,000 after neighbor pours disinfectant in front of her apartment
A woman who sued her neighbor, who reportedly poured pungent disinfectant in front of the complainant's apartment, causing her health problems, had her case dismissed on appeal. The Al Ain Court of Appeal upheld a previous verdict by the Court of First Instance, which had dismissed the woman's complaint due to a lack of evidence. According to court documents, the woman filed the complaint against her neighbor, requesting that she pay her Dh60,000 in compensation for the harm done to her health. The woman claimed that her neighbor poured the disinfectant, which had a strong odor, in front of her apartment under the guise of cleaning. She showed CCTV footage of her neighbor pouring the disinfectant in front of her property as proof to back up her accusations. She also provided medical records demonstrating that she suffered from respiratory sickness and sought treatment after inhaling the noxious odor of the disinfectants. The defendant denied causing any injury to the plaintiff and sought that the case is dismissed due to a lack of adequate evidence that the disinfectant caused harm to the plaintiff. The complaint had previously been dismissed by the Court of First Instance because there was no proof that the disinfectant was dangerous. The woman appealed the ruling, and the appeals court upheld the lower court's decision. The plaintiff will cover the defendant's legal fees.
