A man filed a lawsuit in the Abu Dhabi Court of First Instance, claiming that he had mistakenly put Dh3,269,000 in another person's account who refused to return the money. The appellant asked the defendant to return the money and pay the lawsuit's fees and expenses and the lawyer's fees. The appellant explained that the appellee transferred parts of the amount to other accounts and withdrew another part in cash. He went on to say that he filed a criminal case against the appellee and that the latter was convicted by the Abu Dhabi Court of Cassation in a final ruling. He added court decisions, the appellee's account statement, and a consultant's report to his complaint. The court confirmed that the criminal court had already investigated the case, which the civil court must follow, and thus the civil court must carry out the verdict. The court went on to say that it was proven that the appellee had to refund the money, saying that it relied on the consultant's report attached to the case file, which demonstrated that the appellee owed the complainant Dh2,469,000. The court noted that the case papers lacked evidence that the appellee had paid the amount to the complainant and thus required him to pay the amount in addition to the lawsuit's fees and expenses and the lawyer's fees.
