The Abu Dhabi Family, Civil and Administrative Cases Court has ordered a man to repay Dh400,000 to his former gym partner after he failed to honor a payment agreement related to gym equipment. The court also ordered a 4 percent interest on the amount starting from the date the lawsuit was filed until the full amount is paid. According to court documents, the plaintiff said he loaned the defendant Dh400,000 to purchase gym equipment under the condition that it would be repaid in 12 monthly installments of Dh33,333.33. A settlement was signed, but the defendant failed to comply. The plaintiff submitted a legal case seeking the amount plus Dh10,000 in compensation for material and moral damages, along with 12 percent legal interest and associated fees. The court reviewed supporting evidence, including a signed settlement agreement, a payment notice, and email correspondence between the parties. The defendant appeared in court and acknowledged the agreement, stating that he was unable to pay the installments due to the closure of the gym. However, the court ruled that the defendant had provided no proof of payment and determined that the plaintiff had the legal right to reclaim the amount. “It is proven in the submitted documents that the defendant borrowed Dh400,000 from the plaintiff and pledged to repay it in 12 equal monthly installments,” the court said in its ruling. Since the settlement was legally binding and no payments were made, the court ordered full repayment of the amount with additional interest. ICA/Expat Media
