Abu Dhabi Global Market (ADGM) has announced new employment regulations that allow companies to hire remote and part-time workers, ushering in a more flexible work environment. Set to take effect on April 1, the regulations redefine the term "employee" to include remote and part-time staff for companies operating under ADGM. The updated framework aims to enhance clarity regarding employer and employee rights, reflecting the evolving nature of workplace practices. "This is a significant step toward modernizing employment structures. By enabling flexible work arrangements, we are fostering an innovative and adaptive business environment," said Hamad Sayah Al Mazrouei, CEO of the ADGM Registration Authority. Remote employees can reside within or outside the UAE but must operate primarily from a location other than their employer’s premises. The law mandates employers to specify remote work arrangements in contracts and provide the necessary technical equipment for job performance. Part-time employees, defined as those working less than eight hours daily or fewer than five days weekly, also fall under the new provisions. Employers are required to ensure these workers enjoy fair treatment, including sick leaves and protection from workplace discrimination. "These regulations reflect global changes in workplace dynamics, offering businesses in ADGM a competitive edge while ensuring employee well-being," Al Mazrouei added. The new rules cap probation periods at six months. Employees on probation are entitled to sick leave but not sick pay. Termination during this period requires a week's written notice. The legislation also emphasizes workplace equality, prohibiting discrimination based on gender, marital status, pregnancy, age, religion, or disability. Employers are barred from victimizing employees for filing complaints related to discrimination. Companies have until April 1 to align their internal policies with the updated framework.
