Abu Dhabi's Court of Cassation has upheld the Abu Dhabi Commercial Court's ruling against a local store found guilty of illegally using the trademark of a globally renowned fashion and e-commerce brand. The case was filed by the company that owns the trademark, after discovering that the store had been using its brand name and logo on storefronts, products, advertisements, and online platforms—without any authorization. The court issued a strict directive for the business to immediately cease and delete all its use of the brand’s trademark in its signage, marketing materials and social media content and to stop selling any products bearing the brand’s name or logo. The business was also ordered to remove the fake trade name from the records of the Abu Dhabi Department of Economic Development and all commercial registries across the UAE. The unauthorized use of the brand’s identity misled customers into believing the store was affiliated with the original company, which operates solely online and has no physical branches. The court emphasized that the infringement was a violation of UAE intellectual property laws and international agreements, underlining the country's commitment to protecting trademarks. The ruling, which was upheld on appeal and confirmed by the Court of Cassation, is now final and enforceable. ICA/Expat Media
