Five men charged with aiding defendants in irregular land transaction acquitted

  DUBAI – The Court of Appeal has upheld the 15-year prison sentence meted by the criminal court on the former American chief executive of Deyaar real property company and his three fellow US citizens who were charged with theft and fraud in relation to a 2007 land transaction. The appellate tribunal also upheld the fine imposed on the four Americans and to pay back Dh56 million to Deyaar. The court likewise acquitted five others who were charged with aiding the four defendants. Court records showed that Zack Sahin, 56, and the three other defendants were accused along with five others and three former Deyaar executives of deceiving the company into paying an inflated price for a plot of land in Houston, Texas, USA in November 2007 and filching Dh56.3 million from the sale of the lot. Shahin and the others denied the accusation. But on July 30, 2012, the prosecution presented documents pertaining to the land deal to the criminal court that were notarised from the Ministry of Foreign Affairs in Washington DC and by UAE authorities, which detailed the activity of two escrow accounts of American National Title Company in the Amegy Bank of Texas in December 2007. The proceeds from the land sale were transferred to the two escrow accounts. The documents included a report issued by the Dubai financial audit department dated May 16, 2012. Shahin was arrested in 2008 during an investigation into the financial irregularity then he went on hunger strike on May 14, 2012 and was released in July that year after posting Dh5 million bail on the condition that he would remain in the UAE. Shahin however fled the country but was rearrested in Yemen and deported to the UAE.
