Judge rejects appeal of Pakistani defendants; convicts to be deported after serving prison sentence

  DUBAI – The Dubai Appeal Court upheld a three-year jail term meted by a lower court on three Pakistani workers for gang-raping their roommate in January last year. The trio, aged 19, 21 and 30, had asked the appellate court to overturn the prison sentence handed down by the Dubai Court of First Instance last November. Court records said the three workers sneaked into a room they shared with the victim in a labour accommodation in Jebel Ali, pinned their roommate down then gang-raped him. The complainant said: "I woke up suddenly to someone feeling my back at around 11pm. When I tried to use the mobile's light to see who it was, I saw the three defendants. They asked to have sex with me, but I refused. They all seemed drunk. When I tried to exit the room, they prevented me. They restrained me and raped me one at a time. One of them slapped me when I tried to resist. Another defendant gagged me when I tried to shout and cry for help. They overpowered me and abused me sexually." A police investigator, on the other hand, told the court: "When we reached the labor accommodation where the incident happened, I saw the claimant petrified and quivering. Upon recording his statement, he said that he had been raped by the three assailants." The trio were subsequently charged and ordered jailed by the court. When the three convicts appeared before Appeal Court presiding judge Saeed Salem Bin Sarm, they denied raping their roommate and claimed that what happened among them was consensual sex. Two of the convicts said they had sex with the complainant in the past. The judge however rejected the convicts' appeals and upheld their jail sentence. The magistrate also ordered their deportation after serving their prison sentence. The appeal court's ruling is subject to further appeal before the Cassation Court within 25 days.
