Ombudsman orders indictment of the e-xpresident in connection with botched raid

  MANILA – The Office of the Ombudsman has ordered the criminal indictment of former President Benigno Aquino III and two other former police officials in connection with a botched raid in Mamasapano town against Muslim rebels on Jan. 25, 2015 that resulted in the deaths of 44 members of the Special Action Force (SAF). The SAF commandos were tapped in the operation codenamed Oplan Exodus to go against members of the Bangsamoro Islamic Freedom Fighters (BIFF) and the Moro Islamic Liberation Front (BIFF) who were in Mamasapano and capture or kill wanted Malaysian terrorist and bomb-maker Zulkifli Abdhir, other Malaysian terrorists and leaders of the BIFF. However, the SAF members ended up getting ambushed by the Muslim rebels. Mamasapano is a town in the central Mindanao province of Maguindanao. In a resolution issued yesterday, Ombudsman Conchita Carpio-Morales said Aquino, former Philippine National Police (PNP) chief Alan Purisima and former SAF commander Getulio Napeñas were criminally liable for the failed police operation that became known as the "Mamasapano Massacre". Aquino, Purisima and Napeñas will face charges of usurpation of authority and violation of the antigraft law. The usurpation of authority charges carries a four-year prison term while the maximum penalty for the graft charge is 10 years in jail. Morales incidentally was the one who administered Aquino's oath of office. Aquino also appointed Morales as anti-graft investigator after she retired from the Supreme Court. Morales cited in her resolution the text messages between Aquino and Purisima that showed that the "suspended police chief played a major role in the botched operation." Those text messages were revealed during a Senate investigation into the "Mamasapano Massacre". Prior the "Mamasapano Massacre", Purisima was under suspension over an alleged irregular gun license delivery deal. According to Morales, Purisima usurped authority by playing a role in Oplan Exodus "to the point that he was exercising a degree of authority and discretion over Napeñas and consequently, over the operation" in Mamasapano while Aquino was ordered indicted when he "assented to or at the very least failed to prevent Purisima" - who was serving suspension - from getting involved in the operation. She pointed out that the law bars a suspended official "from performing any public functions and from meddling into the affairs of the government." Morales said usurpation of authority is "committed by any person who shall knowingly and falsely represent himself to be an officer, agent or representative of any department or agency of the Philippine government." She further said that Aquino violated a provision in the antigraft law which prohibits a public officer "from inducing or influencing another to perform an act that violates duly-promulgated regulations." Meanwhile, Morales junked a complaint of reckless imprudence resulting in multiple homicide against Aquino, Purisima and Napeñas as she explained that the deaths of the commandos were the result of "the intentional act of shooting by the hostile forces", which was beyond their control.
