Comelec chairman Andres Bautista sues wife over accusations

  MANILA – Following accusations that he has amassed 1 billion pesos in unexplained wealth, embattled Philippine Commission on Elections (Comelec) chairman Andres Bautista will be investigated by the Senate Blue Ribbon committee. This as Bautista said today (Wednesday) that he has filed charges against his estranged wife, Patricia Paz "Tish" Bautista, over her accusations that he has ill-gotten wealth. Senate Majority Leader Vicente Sotto III sought the probe after Mrs. Bautista accused Mr. Bautista of unexplained wealth and receiving commissions from a law firm for referring clients. After Sotto proposed the investigation, Senate Minority Leader Franklin Drilon objected to the move saying that the Blue Ribbon committee has no jurisdiction to investigate Mr. Bautista and that an impeachment complaint can be filed against the poll official instead. Mr. Bautista can only be removed from office via impeachment if he does not resign. But Sotto said the Blue Ribbon committee can investigate an official like Mr. Bautista, recalling that the body had probed Vice President Jejomar Binay of corruption allegations in 2014. Drilon dropped his objection with reservations while Sotto assured that the Blue Ribbon committee probe on Mr. Bautista will be stopped once an impeachment complaint is filed against the Comelec head at the House of Representatives. Once an impeachment complaint is filed at House of Representatives against an impeachable official, the House justice committee looks into its form and substance and if the two requirements are met, the case is forwarded to the plenary for approval by a majority vote of the congressmen. When that is achieved, the case is forwarded to the Senate, which will conduct an impeachment trial. Sotto said the probe would be in aid of legislation and not meant to find if Mrs. Bautista's claims are true. Meanwhile, Mr. Bautista said in an ABS-CBN News Channel Headstart interview today (Wednesday) that he has filed charges against Mrs. Bautista but did not say where. "We filed a case for grave coercion, for qualified theft and robbery, and also for extortion which is in the form of grave threats and life threats," he said. He criticized his wife for showing documents on his alleged ill-gotten wealth to the media instead of presenting them in court. Mrs. Bautista had alleged in an affidavit submitted to the National Bureau of Investigation (NBI) last week that she had discovered bank and real property papers and several passbooks in Mr. Bautista's name that were not included in his 2016 Statement of Assets, Liabilities and Net Worth (SALN). Mr. Bautista had declared a net worth of P176.3 million in his SALN last year. Aside from that, Mrs. Bautista also alleged that her husband received commissions from DivinaLaw, one of the Philippines' fast-growing law offices, for referring clients to them. Mr. Bautista denied amassing unexplained wealth. As regards the commissions, he said the monies were not "public funds". He said the money was like referral fees and the arrangement between him and DivinaLaw was already existing even before he joined the government.
