Woman wins Dh1.1m compensation for surgery gone wrong at hands of doctor in Jumeirah

  DUBAI – A Dubai court has ordered Dh1.1 million in compensation for a woman who became infertile after a botched surgery of her fallopian tube. The Libyan woman underwent surgery performed by an American gynaeocologist in Jumeirah. The woman said that the doctor did not give her proper follow-up health checks, leading to complications after her surgery that eventually made her infertile. She had to undergo nine more surgeries to fix the damage, her lawyer said. She, along with her husband, filed a criminal lawsuit against the gynaecologist, who was ordered by the court to pay Dh430,000 in compensation. “That amount was not enough to compensate them against their moral, emotional, financial and medical damages. They have lost the probability of being normal parents, like any other, due to the defendant’s negligence. Their damages have become permanent,” her lawyer, Yousuf Al Beloushi, told the Dubai Appeal Court. He said that in the initial civil lawsuit they had sought Dh6 million in compensation. “After the operation her abdomen was bloated with gases and a brownish substance that had a bad smell. My clients had high hopes that one day they would become parents… that hope was killed due to the defendant’s recklessness that ended with her becoming childless,” Al Beloushi said. The Dubai Appeals Court increased the compensation amount for the woman to Dh1.1 million, saying she deserved it after “moral, emotional and financial damages”. The court also ruled that the woman’s husband will get Dh100,000 as compensation. The ruling can be appealed within 53 days.
