Former chief executive of real estate company also fined a total of Dh92 million

  DUBAI – After nine years and three months of litigation, the Dubai Cassation Court decided to uphold two jail sentences totalling 25 years meted on former Deyaar chief executive Zack Shahin. Shahin, an American-Lebanese, had appealed to the Cassation Court to acquit him in two graft cases that were filed against him and three others involving Dh56 million and Dh43 million, respectively, during his stint at Deyaar. Aside from dismissing the appeals, Cassation Court presiding judge Abdul Aziz Abdullah ordered Shahin to pay a total of Dh92 million in fines. The litigation of the two cases against Shahin and several others started in May 2009. Court records showed that in the first case, Shahin and the three other defendants were accused along with five others and three former Deyaar executives of deceiving the company into paying an inflated price for a plot of land in Houston, Texas, USA in November 2007 and filching Dh56.3 million from the sale of the lot. Shahin and the others denied the accusation. But on July 30, 2012, the prosecution presented documents pertaining to the land deal to the criminal court that were notarized by the Ministry of Foreign Affairs in Washington D.C. and by UAE authorities, which detailed the activity of two escrow accounts of American National Title Company in the Amegy Bank of Texas in December 2007. The proceeds from the land sale were transferred to the two escrow accounts. The documents included a report issued by the Dubai financial audit department dated May 16, 2012. Shahin and his co-respondents were convicted and meted a 15-year jail sentence. They were also fined Dh56 million. Shahin was arrested in 2008 during an investigation into the financial irregularity then he went on hunger strike on May 14, 2012 and was released in July that year after posting Dh5 million bail on the condition that he would remain in the UAE. Shahin however fled the country but was rearrested in Yemen and deported to the UAE. In the second case, the court convicted Shahin, an Indian former operations' manager of Deyaar and an Argentinian company owner on three counts of financial irregularities involving Dh250 million. The court each sentenced them to spend 10 years in jail, fined Dh36 million, and ordered to repay the same amount to Deyaar. The court also affirmed the three-year imprisonment of an Indian marketing manager. Charges of abuse of office, illegal profiting, dispersing public funds, divulging secrets, forgery, breach of trust, swindling, deception, embezzlement, bribery and other charges were also filed against an Emirati former minister, two Indian executives, a Lebanese sales representative, a Palestinian sales director and a Pakistani salesman. However, due to lack of evidence, the five suspects were all acquitted. The case against the former Emirati minister was dismissed after he passed away.
