The Al Ain Court of Appeal confirmed a judgment by the Court of First Instance ordering a man to pay Dhs70,000 in damages to a woman for the material and moral harm she suffered after he assaulted her and caused her shoulder injuries and a 30% disability in her upper left arm. The details go back to when the woman filed a case demanding that the appellee pay her Dhs100,000 in compensation, plus costs, expenses, and legal fees. According to the victim's claim, the defendant assaulted her and caused her damage to her shoulder bone, humeral joint ligament sprain, neck ache, and pain in her right and left leg. She stated that he had been found guilty of the crime and that a court order had been issued against him. The court appointed a forensic, who confirmed that the victim's health condition was stable and that the injuries affected the left shoulder joint's movement and caused slight atrophy of the muscles of the left upper arm, resulting in the inability to carry heavy weights and constant pain, resulting in a permanent disability of 30%. The defendant's attorney sought that the court is notified of the plaintiff's healthcare records from three years prior to the occurrence. The defendant must pay the victim Dhs70,000 in addition to expenditures and Dhs300 in legal fees, according to the Court of First Instance. The defendant filed an appeal, claiming that the plaintiff's injuries were minor and that she was already being treated for them before the occurrence. He also sought that three hospitals be contacted to evaluate their medical files and reports previous to the occurrence, that the verdict is overturned, that the case is dismissed, and that the woman is held responsible for the costs, expenses, and legal fees. The court upheld the prior finding that the defendant assaulted the victim and caused the injuries described in the medical report, rendering her unable to work for a period of not more than 20 days and that the ruling was final. Previously, the Al Ain Court of Appeal ordered a man to pay Dhs96,000 to his sister as her portion of their late father's inheritance and retirement income after she turned 18.
