Abu Dhabi court orders Dh300,000 compensation for parents of boy who died due to medical negligence
The top court in Abu Dhabi has ordered Dh300,000 in compensation for the parents of a boy who died due to medical negligence. The Abu Dhabi Court of Cassation found the hospital and its two doctors guilty of medical negligence that caused the child’s death. The parents sued the hospital and demanded Dh15 million in compensation for moral and material damages that they suffered following the death of their son. They claimed that doctors were “negligent and careless” when they took him in at the hospital and didn’t take necessary medical measures to treat him. The parents said the boy was admitted to the hospital for a “serious illness”. They told the court that the hospital and its doctors, because of their negligence leading to the boy’s death, “deprived them of the opportunity to be taken care of and getting support from their son in their old age.” A court-assigned medical committee that investigated the matter confirmed that there was a medical error in treating the child. The case was first heard at the Al Ain Court of First Instance were judges awarded the boy’s parents Dh90,000 in compensation. The ruling was appealed, and the appeals court still ruled in the parents’ favour, but increased the compensation to Dh200,000. A final appeal from the hospital and the parents took the case to Abu Dhabi’s top court, Abu Dhabi Court of Cassation, where the judge increased the amount of compensation to Dh300,000. The hospital and its two doctors were also told to pay for the parent’ legal expenses.
