Dh7b lawsuit against realty firm and sheikhs dismissed by Dubai's top court

  DUBAI - A Dh7 billion commercial lawsuit filed against a real estate development company and its three sheikh owners has been dismissed by Dubai's top court. The Dubai Cassation Court on Monday (December 26) dismissed the lawsuit that an Iranian businessman filed in 2009. The Iranian had claimed that he had a deal with one of the sheikhs to put up a company in 2004 to get a licence to work and invest in a local industry. He alleged that under the agreement, he was assigned “as its manager and granted broad authority to be able to invest and manage his money which he invested in the company”. He filed the lawsuit after he was dismissed from the company following a commercial dispute with the sheikhs. In court, the sheikhs' lawyers argued that the Iranian failed to prove that the funds invested in the properties belonged to him, adding that the money belonged to the company since the sheikhs "paid the company's capital and the expenses of its establishment". The sheikhs' lawyers also filed a counter-lawsuit demanding that the businessman repay Dh465 million he took while managing the company. In 2012, the primary court dismissed the businessman’s lawsuit and the counter-lawsuit as well. Both parties appealed the primary rulings, which were dismissed in 2015, and filed a final appeal before the Cassation Court. During Monday's final ruling, the Cassation Court dismissed the Dh7 billion lawsuit and the Dh465 million lawsuit.
