Dubai court cancels deportation of Indian expat in drug case
DUBAI – A Dubai court has cancelled a deportation order for an Indian man convicted of drug use in the emirate. The Dubai Criminal Court of First Instance on February 7 overruled the verdict following a change in the law that removes the mandatory deportation of drug offenders. In his appeal, the man’s lawyer said that the Indian “is not a criminal” and will not have any reason to break the law again. The lawyer said that that Indian man has been living with his family in the UAE for more than 30 years, and deportation will “break the family apart”. The 38-year-old Indian man was arrested last November 2020 for smoking hashish. He tested positive for consuming the substance. Police also found drugs at his Downtown Dubai home. In March 2021, the court found him found guilty of drug use and sentenced him to jail followed by deportation. He was also fined Dh5,000. The expat’s lawyer appealed the sentence based on the new anti-drug law for those convicted of minor drug offences. Under the revamped UAE anti-drug law that took effect on January 2, judges will be able to decide if convicted expatriate drug users will be allowed to stay in the UAE after serving their jail term. The new law will focus on the rehabilitation of people convicted of drug use and possession, giving them treatment and education programmes during their detention. First-time offenders can get minimum sentences of three months, but serial offenders will get tougher punishments.
