In a landmark ruling, the Dubai Rental Disputes Center (RDC) has ordered a landlord to pay Dh700,000 in compensation to a tenant after an unlawful eviction. The case involved a European tenant who had fully paid his annual rent to the original property owner. However, after the villa was sold to a new landlord, the tenant faced an unexpected legal battle. The new owner falsely claimed that rent had not been paid and filed an eviction case against the tenant. Adding to the controversy, the landlord provided an incorrect email address for the tenant in legal filings, preventing him from receiving court notifications. As a result, the tenant was unaware of the proceedings and was issued a default judgment for eviction and rent arrears. While the tenant was away on his annual vacation, the landlord moved swiftly to enforce the ruling. Upon returning, the tenant discovered he had been locked out of his home, with all his belongings removed. The landlord had also sought additional enforcement measures, including travel bans and financial restrictions against the tenant. Realizing the legal steps taken against him, the tenant consulted a lawyer and contested the eviction order. A thorough investigation by the RDC found the landlord guilty of misusing the legal system to force an unlawful eviction. The court overturned the eviction ruling, reinstated the tenant’s rights to the property, and nullified all enforcement actions against him. The tenant then filed a lawsuit for damages, citing financial losses, legal expenses, hotel accommodation costs, and emotional distress due to the eviction. After careful assessment, the RDC ruled in favor of the tenant, ordering the landlord to pay Dh700,000 in compensation, equivalent to three years of rent. Judge Abdul Qader Mousa Mohammed, Chairman of the Dubai Rental Disputes Center, emphasized the importance of fair rental practices and warned landlords against fraudulent tactics. “We are committed to ensuring that rental agreements remain stable and that both landlords and tenants uphold their responsibilities. Any attempt to manipulate legal procedures will result in serious legal and financial consequences,” Judge Mohammed said. He further advised tenants to document all rental payments and maintain communication with landlords through official channels.
