Dubai: Court orders man to continue paying alimony to ex-wife, daughters
After the Court of First Instance granted the husband's demand to cancel the alimony for rent and tuition expenses for his four daughters, and the Appellate Court upheld the verdict, the Dubai Court of Cassation ordered the GCC national to pay the alimony to his wife and children again. The husband claimed in a complaint that he filed in the Court of First Instance against his ex-wife, asking for the cancellation of her right to receive the amount established by the Family Court for renting a house, his children's education, and other expenditures. According to the wife's attorney, the husband claimed that his ex-wife was not entitled to housing expenditures because she owned a home and was not entitled to the expenses of two daughters, as they were studying in government schools for free. Furthermore, the husband claimed that one of the daughters worked for the government and earned a monthly salary that met her needs. The Court of First Instance and the appellate court verdict were overturned because the wife did not own a house. According to the lawyer, she obtained the house where she lived through a housing loan from the Mohammed Bin Rashid Housing Establishment, which can be returned to the Establishment if she does not commit to paying the prescribed installments. In an appeal to the Court of Cassation, he also stated that two of the plaintiff's daughters were of determination. They required special care and expenses that exceeded the amount decided, and the other girl was working for a government body on a temporary contract with a monthly payment of no more than Dh10,000. The Court of Cassation overruled the appealed verdict and denied the husband's request to cancel the ex-wife's rent and his daughters' monthly costs.
