A Dubai Real Estate Court has ordered a well-known resort and hotel to pay Dh100,000 in compensation to a European woman whose apartment suffered significant damage due to rainwater leakage. According to court documents, the plaintiff, who owns a unit in the hotel, filed a lawsuit demanding Dh220,000 in damages, citing both material and moral losses. She argued that the property's insulation work had been neglected, leading to severe water damage to her furniture and living space. Expert reports submitted to the court confirmed that the leakage was due to deficiencies in the waterproofing process, a structural violation that warranted compensation. The real estate developer and maintenance company argued that the plaintiff failed to submit official complaints before filing the lawsuit and that maintenance was the owner's responsibility. However, the court ruled in the woman's favor after reviewing technical reports and legal arguments. "The law obligates real estate developers and responsible companies to adhere to engineering standards and carry out necessary maintenance," said Dr. Alaa Nasr, her legal representative. "It also grants consumers and owners the right to claim compensation when contractual obligations are breached."
