The Dubai Court of Appeal upheld the sentences of two construction site managers on Tuesday after a security guard was killed when he was pinned between a crane and a lorry. The two men—a safety supervisor, 35, and a project manager, 28, both from India—were given a month's suspended sentence, a Dh3,000 fine, and they were each ordered to pay Dh200,000 in blood money to the deceased man's family. The first verdict for causing the wrongful death of the guard was given by the Dubai Misdemeanour Court, where the judges said they had been lenient. The victim was found to be partly to blame for his death. The Court of Appeal upheld the sentence after the prosecution requested a harsher punishment. According to court documents, the incident occurred on August 28, 2016, after 8pm at a villa construction site in Jumeirah. Witnesses told the judges that a medium-sized electric generator had arrived on site in a lorry, but workers needed a crane to lift it. A security guard who was killed was the one who steered the on-site crane toward the lorry. He then leaped between the crane and the truck to pull the generator's ropes tighter. According to the lorry driver, who testified in court, the crane moved and crushed the guard because the brakes weren't working correctly. The victim attempted to push the crane away from him to stop it from moving forward but failed and became stuck between the two vehicles, according to the driver. According to a medical report, the man's chest and abdomen were reportedly the cause of death. Inspectors from the Dubai Municipality stated in their report that the failure of safety protocols and allowing the security guard to operate the crane while not qualified were the accident's leading causes. The two men were charged with wrongfully causing the guard's death. They denied the charge in court but were found guilty.
