Expat murder in Dubai: March 25 sentencing in British editor's case
DUBAI – The court is expected to hand down a verdict on March 25 in the case of a British editor accused of the premeditated murder of his wife.
Francis Mathew, 61, had pleaded not guilty to intentionally killing his wife, 62, at their villa in Dubai's Umm Suqueim area.
The victim was found dead on July 4, bleeding profusely from injuries to her forehead, which police said was the result of two severe blows with a hammer.
At the hearing on Wednesday, Mathew's lawyer said the former Gulf News editor was driven by "intense outrage" after his wife relentlessly provoked him.
"The victim started provoking, insulting and demeaning my client the previous night … despite his attempts to avoid her all night long, the victim repeatedly provoked him. He was under severe provocation and the assault happened in very few minutes. Her behaviour sent him into a state of distress and anger,” defence lawyer Ali Abdullah Al Shamsi told the court.
He said that Mathew did not intend to kill his wife and "lost control over himself, his actions and couldn’t realise the consequences of what he did".
Al Shamsi also blamed the couple's marital disputes over finances as a trigger for Mathew's actions.
“She called him a failure and a bad person and that he had to make more money… They had recent financial pressures that was the point of discussion between them during the night when the incident happened," he said.
"Despite having avoided clashing with her all night long, the victim persistently provoked her husband and kept pushing him to the extreme limit," he added.
He also handed the judges a waiver from Mathew's son, which indicates that he has pardoned his father and has dropped his rights in the case. Mathew's son was not present at the hearing on Wednesday.
The 90-year-old father of Mathew's wife was reportedly not willing to pardon him.
Meanwhile, Al Shamsi also asked the court to modify the charge against Mathew from premeditated murder to assault leading to death.
He presented copies of the couple's hotel bookings and travel tickets, claiming that these indicated that Mathews "did not have a premeditated intention to kill the victim as the couple had made booking arrangements to spend the summer vacation in London".
"We also ask the court to treat the suspect with utmost leniency,” Al Shamsi said.
Mathew could face five to seven years in jail, or blood money payment of Dh100,000 if his murder charge is modified by the court.
On July 4, 2017, Mathews reported to police that thieves broke into the couple's villa and killed his wife.
Police, however, found evidence of foul play and called him in for questioning. He later confessed to killing his wife with a hammer and disposing of the murder weapon in a garbage bin a few kilometres away from his home.
