Emirati sisters lose London hammer attack case
DUBAI – Three Emirati sisters injured in a hammer attack at a hotel in London called for justice after they lost their case for compensation.
A UK court ruled on Friday that the Cumberland Hotel, now Hard Rock Hotel, was not liable for the attack on its guests.
Fatima, Khulood and Ohoud Al Najjar were staying in adjoining rooms on the seventh floor when Philip Spence entered through an open door and bludgeoned the Abu Dhabi sisters with a claw hammer during the April 6, 2014 incident.
The attack left Ohoud severely brain damaged. She also lost her left eye in the incident. Spence was convicted of three counts of attempted murder and sentence to life in jail.
The Emirati sisters also sued the hotel owners, arguing that the hotel did not have adequate security, which allowed Spence to enter and access the guest floors.
In his judgement on Friday, Justice Dingemans said that the hotel "acted with reasonable care to protect guests at the hotel against injury caused by the criminal acts of third parties".
In a statement regarding the ruling, the Al Najjar sisters called the verdict a “travesty”, adding that “justice has not been done”.
“Reliving the horrors of that terrifying night where we almost lost our lives has been extremely traumatic for us to endure and we are devastated that it has all been for nothing,” the sisters said in a statement.
“We lost our sister and our lives were changed forever when we were attacked by Spence in the privacy of our own room. Yet still the owners of the Hard Rock have managed to argue successfully that they were not responsible for what happened to us,” they said.
During the hearing, the hotel argued that the sisters were guilty of negligence for leaving their hotel door open, which allowed the intruder to enter.
The Al Najjar’s team of legal experts said they are considering an appeal.
