Jejomar Binay, Jejomar Jr. allegedly rigged procurement for a schoolbuilding

  MANILA – Former Vice President Jejomar Binay and his son, dismissed Makati City Mayor Jejomar Jr., have been charged with graft and falsification of documents for allegedly rigging procurement for the construction of the P1.2-billion Makati City Science High School. In two resolutions issued on Aug. 1, Ombudsman Conchita Carpio-Morales approved the finding of probable cause to criminally indict the Binays of four counts of violating Section 3(e) of the Anti-Graft and Corrupt Practices Act and three counts of falsification of public documents. The graft and falsification charges against the Binays are bailable. Jojo Salgado, a spokesman for the former Vice President, criticized the filing of charges and described it as part of the Ombudsman's "witch-hunt against Binay and his family." "The allegations have been answered but apparently disregarded by the Ombudsman. It once again underscores the selective prosecution of the Binays and the Ombudsman's tendency to look the other way when other political personalities are involved," Salgado said. The cases arose from complaints filed by the Office of the Ombudsman's Field Investigation Office, which looked into contracts for the schoolbuilding entered into by the Makati City Government during the tenure of the Binays. The elder Binay was mayor of Makati City for several years. When he ran and won as Vice President, his son was elected as successor. At the moment, there is basis to indict Binay and his son for violating procurement rules. If they are convicted, the Binays face six to 10 years in prison for each count of graft, and six to eight years for each falsification count. As regard the issue of overprice of the schoolbuilding, it is still being investigated, a source at the Ombudsman's office told the Philippine Daily Inquirer. Also, the Ombudsman's Office still has to resolve the plunder complaint filed against the Binays in 2014. The Binays can still file a motion for reconsideration of the Ombudsman's resolution on the criminal aspect of the case but if the appeal fails, the case will be filed at the special appellate collegial court, Sandiganbayan. The Binays however have a pending graft and falsification case at the Sandiganbayan in connection with the 2.2-billion-peso Makati City Hall carpark building project.
