Nanterre tribunal says photos taken of the topless Duchess 'an invasion of privacy'

  PARIS – A court in the French suburb of Nanterre have ruled in favor of Prince William and his wife, Catherine, in a lawsuit filed by the royal couple against a French magazine that published photos of the duchess while sunbathing topless during a vacation in the south of France in 2012. The tribunal said the pictures were "an invasion of privacy". The court awarded 100,000 euros in damages to the duchess and Prince William and imposed the maximum fine prescribed by French law (45,000 euros or about US$53,500) on the editor of Closer magazine and the chief executive of the group that owns the publication. After the ruling was handed down, reports said Paul-Albert Inweis, main lawyer for Closer, called the fines "somewhat exaggerated". "This case raises real issues regarding freedom and we will consult with our clients," Inweis added. The Duke and Duchess had asked for 1.5 million euros or almost US$1.8 million in damages after the magazine and French regional newspaper La Provence published grainy photos that showed the duchess sunbathing topless. The photos were taken with long lenses as the royal couple stayed at a private chateau owned by Viscount Linley, nephew of Queen Elizabeth II. Prince William lambasted the publication of the photos of his wife and called it "particularly shocking" as he recalled memories of his late mother's battles with the paparazzi. Princess Diana – the Prince's beloved mother – died in August 1997 in a car accident as she fled the paparazzi in Paris. In 2012, a court had fined Closer for printing the images and was banned from distributing the print magazine and online. The tribunal also ordered Closer to hand over the original images to the British royal family and pay them 2,000 euros (around US$2,600).
