House to file ethics rap against De Lima with discipline of legislator to be sought by Congress

  MANILA – In order to stave off a confrontation between the two houses of Congress over what to do with Senator Leila De Lima, the House of Representatives has agreed to file an ethics complaint against the legislator before the Senate for alleged obstruction of justice instead of ordering her arrest. This was agreed upon by leaders of both chambers of Congress in a meeting Monday night, according to Senator Majority Leader Vicente Sotto III, who also heads the Senate ethics committee. Sotto said the meeting "went well...and we agreed to avoid any confrontation between the two Houses." Sotto also said the Senate will not stop the show-cause order to be issued by the House after De Lima allegedly told her former bodyguard and driver Ronnie Dayan not to attend the House hearing on the illegal drug trade in the national penitentiary during De Lima's stint as justice secretary in the previous administration. Dayan is De Lima's alleged drug money bag man and erstwhile lover. Dayan was arrested last week in La Union province, north of Manila, and brought to the capital to attend the hearing, during which he accused De Lima of receiving drug money from drug lords to finance her senatorial campaign in the elections last May. De Lima denied the accusations. The congressmen present in the House hearing said de Lima's act constitutes "obstruction of justice." They want the senator to appear before the House and air her side on the matter. If De Lima refuses to heed the show cause order, House Speaker Pantaleon Alvarez said he may order an arrest of De Lima, a move that would put the two chambers in direct confrontation because it will violate the principle of parliamentary courtesy and legislative independence. Sotto said it will be up to de Lima to decide how to deal with the show-cause order but the Upper House will act on any ethics complaint to be filed against De Lima. So far, the ethics committee has received two complaints already against De Lima. The House of Representatives will ask the Senate to discipline De Lima, it was learned.
