Legislators find complaint sufficient in form and substance

  MANILA – The committee on justice of the House of Representatives on Wednesday deemed one of two impeachment complaints filed against Chief Justice Maria Lourdes Sereno as sufficient in form and in substance. By a vote of 30-4, the committee said there was enough basis to deliberate on the complaint filed by lawyer Lorenzo Gadon against Sereno. Gadon had accused Sereno of allegedly failing to declare her true net worth, buying a car using public funds and making questionable decisions without consulting her fellow justices at the High Court. The committee chaired by Congressman Reynaldo Umali of Mindoro Oriental however rejected the second complaint against Sereno by a vote 28-5 due to flawed wording in the verification papers. The committee declared that Gadon's complaint was in order even if some lawmakers questioned the use of newspaper articles to bolster his case against Sereno. The Chief Justice has been given 10 days to answer the charges. After Sereno files her reply, the committee will conduct hearings to determine if the complaint has sufficient grounds and probable cause. Meanwhile, Sereno's spokesman, Carlo Cruz, said Sereno's legal team would file its rebuttal to the complaint. Cruz, who is a Constitutional expert, also said in a statement that the accusations against Sereno were not impeachable offenses as defined by the 1987 Constitution and were "unsupported by evidence or rely mainly on hearsay consisting of newspaper (articles)." If the justice committee finds sufficient grounds and probable cause against Sereno, the impeachment complaint will be endorsed to the plenary where it will be voted on. A vote of one-third of the 293-member House of Representatives is needed to endorse the case to the Senate which will hold an impeachment trial. If Sereno gets impeached, she will be second Chief Justice to be ousted. Her predecessor, Renato Corona, was impeached in December 2011 and found guilty by the Senate, acting as an impeachment court, in May 2012 for failing to disclose his real wealth in the statement of assets, liabilities and net worth (SALN).
