Medical panel declares that it would be dangerous for girl to deliver at a young age

  ROHTAK, India – A district court has allowed a 10-year-old rape victim to have an abortion after a medical board declared that giving birth at such a young age is dangerous for the girl. The girl was impregnated by her stepfather who raped her several times in the past and had been arrested. The girl is due to give birth in four months, according to the police. The court's decision came after Post Graduate Institute of Medical Sciences (PGIMS) in Rohtak district in Haryana state examined the girl and declared it would be dangerous for her to carry the child to full term and give birth. The medical board of the same institute however pointed out that abortion would also be dangerous but the panel decided to let the court on the issue. The medical board let the court decide on the matter of abortion since the girl is already 20 weeks pregnant based on an examination done by Dr. Prashant Kumar at the PGIMS. Under India's Medical Termination of Pregnancy Act, abortion is not allowed after 20 weeks of pregnancy "unless the termination of such pregnancy is necessary to save the life of the pregnant woman." Dr. S.K, Dhattarwal, head of the institute's forensic science department, told CNN: "The court has asked the doctors to terminate the pregnancy. We are examining the female to determine the best method for abortion." He also said the abortion was going to be conducted last night or tonight. The girl's pregnancy was discovered after her mother, who is a laborer from Bihar, brought her to a doctor for an examination on suspicions that she was carrying a child. When it was confirmed she was pregnant, the girl told her mother that the stepfather had been raping her. "The stepfather has been arrested and is in jail. The victim has been given counseling and necessary medical care, and her statement was recorded before a magistrate.The abuse had been going on for years," said Pankaj Nain, Rohtak police superintendent. The girl needed to undergo counseling because of severe mental trauma, according to Dr. Raj Singh Sangwan, chairman of the Rohtak child welfare committee. "Her mother said she was a little unstable for a long time after she had suffered a head injury. So she was not even going to school. Her legal aid and compensation will be taken care of," Sangwan told Hindustantimes.
