Lloyd's won't allegedly pay rapper due to medical condition caused by drug use
LOS ANGELES - Kanye West has filed a US$9.8 million (7.4 million British pounds) damage suit against insurance company Lloyd's of London over his cancelled Saint Pablo Tour shows.
West's company, Very Good Touring, claimed that Lloyd's has allegedly hinted it won't pay the rapper because of a medical condition caused by alleged marijuana use that prompted West to cancel the remainder of his world tour – an accusation that West rejected.
West, 40, called off the final 21 shows of his tour in November last year and was admitted to a hospital. The tour was supposed to run until December 2016.
Lloyd's, for its part, refused to issue any comment on the matter. A spokeswoman told BBC: "We're not able to comment on matters in litigation."
Aside from suing for damage, Very Good Touring is demanding payment of interest over the alleged violation of the contract.
It was The Hollywood Reporter that first saw documents of the case and reported about it.
In the court papers, West's lawyer Howard King wrote: "They (have not) provided anything approaching a coherent explanation about why they have not paid, or any indication if they will ever pay or even make a coverage decision, implying that Kanye's use of marijuana may provide them with the basis to deny the claim."
King also said West spent "hundreds of thousands of dollars" on insurance with Lloyd's to cover the costs of a cancellation but has not been paid.
The Saint Pablo world tour was supposed to run until December 2016. After cancelling the remaining shows, West was admitted at a neuropsychiatric centre at UCLA in Los Angeles where he was confined for eight days.
King said Lloyd's claim that cannabis use led to West's "serious, debilitating medical condition" is an "unsupportable contention".
King also said Lloyd's tapped a lawyer to deal with West's claim for payment. King said: "Immediately turning to legal counsel made it clear that defendants' goal was to hunt for any ostensible excuse, no matter how fanciful, to deny coverage or to manoeuvre themselves into a position of trying to negotiate a discount on the loss payment."
The lawyer accused Lloyd's of allegedly sharing confidential information about West to media outlets to intimidate the rapper from taking legal action and criticized the insurer of allegedly accepting "bounteous" premiums and engaging in "unending" investigations to avoid making payout decisions.
"The stalling is emblematic of a broader modus operandi of the insurers of never-ending post-claim underwriting where the insurers hunt for some contrived excuse not to pay," King said.
