Asks Cassation Court to overturn appellate tribunal's decision to affirm death penalty on Nidal Eisa Abdullah

  DUBAI - The lawyer of the killer of nine-year-old Jordanian boy Obaida Sedqi wants a new trial for his client as he questioned the conclusiveness of the sanity test done on the accused. Ali Musabbeh, lawyer of convicted killer Nidal Eisa Abdullah, argued before the Dubai Cassation Court yesterday that while the medical report confirmed that Nidal suffers an antisocial personality disorder with alcohol dependence, "the report was too general, not very clear and inconclusive." "It lacked details that justify or explain why he suffers that disorder and why is he considered a danger to the society. The report just said that he is an antisocial person," he also said. Musabbeh pointed that there were no psychological and neurological tests done on Abdullah "and had those tests been carried out, they would have given a clearer picture of the defendant's mental state." Musabbeh told Cassation Court presiding judge Abdul Aziz Abdullah that he is "defending the law and not the crime. I am complementing the court's role in ensuring that the law enforcement procedures are carried out properly." "The appellate court should have approved our demand to have the defendant be reexamined. We (the defense) had asked the Appeal Court to resend (Nidal) Abdullah for second psychiatric evaluation to decide whether he suffers from a certain mental illness that makes him temporarily irresponsible for his actions and behaviours and particularly at the time when he committed the crime," he said. He asked Judge Abdullah to overturn the appellate court's decision to uphold the death penalty on Nidal Abdullah. Musabbeh also asked the Cassation Court to refer the case to a new panel of appellate judges to look into it. A ruling will be issued by Cassation Court on Musabbeh's motion on February 27. The Dubai Court of Appeal affirmed last January 22 a decision by the lower court to impose the death penalty on Nidal Abdullah. Nidal had filed an appeal to have his sentence reduced. Nidal Abdullah kidnapped Sedqi from his father's garage in Sharjah on May 20 last year. He brought the boy to Al Mamzar in his car and raped Sedqi at the backseat before killing him.
