How to register a trademark for your UAE business

DUBAI – With new businesses opening up in the UAE, more and more entrepreneurs are looking into registering their trademarks to not only protect their creative energy and brand, but also to secure their profits. Registering a trademark in UAE can also help in protecting the local market from getting confused as to the source of products and help a business in succeeding. In this article, we'll take a look at the process that is involved with trademark registration in UAE. Before we touch upon the steps, let’s first address the question:

Where can I register a brand or trademark in UAE?

The government institution that is in charge with the registration and granting of trademark rights is the Ministry of Economy (MOE). The MOE protects trademarks in the UAE, providing trademark holders the ability to enforce intellectual property rights for ten years or longer, following renewal. Yes, that means ownership to a mark can be extended indefinitely.

What are the steps to register a mark in UAE?

Follow the following steps to register your trademark in UAE.

1. Fill out the registration application

Register the mark that you have chosen by filing an application with the MOE. The registration application form has to come complete with the other requirements such as power of attorney, list of products and/or services that will be covered or protected by the mark, priority document, passport copy of the applicant for trademark registration, copy of the trade license of the applicant, and a sample of the trademark logo. Other kinds of documents may be asked to furnish.

2. Settle the application fee

An applicant has to pay the fee for UAE trademark registration. An applicant will pay approximately Dh8,000 to Dh15,000 depending on the classes that are covered by the mark to be registered. This cost doesn't include translation fees and legal fees, which may be incurred. If the process has not been carried out properly, it is going to take a much longer time to complete and with a higher cost. This is why it is important to get it right the first time.

3. Allow the MOE to review the application

After the submission of the required documents and settling of the fees, the government authority will review the application. Take note: any wrong info supplied to the MOE can result to the application getting rejected. An appeal may be done, if required.

4. Announce the registration in local newspapers

If the MOE has given their approval for the registration of the mark, it has to be published to local newspapers. Local newspapers where you can publish include Al Fajr, Al Wahda, Al Ittihad, Al Watan, and Al Khaleej.

5. Claim the certificate of trademark registration

If there's no objection to the trademark registration even when it was published in at least two local newspapers, then the MOE will supply the applicant with a certificate of trademark registration. The certificate will contain crucial details such as registration number of the trademark, owner of the trademark, the mark itself, as well as a description of products or services that fall under it. If you want to make sure that you increase the likelihood of your mark to get approved by the MOE, we suggest you seek the help of trademark specialists in UAE like FAR Consulting Middle East for trademark registration in UAE.
