Appeals court upholds suspension order on immigration ban imposed by Trump

  WASHINGTON – The US 9th Circuit Court of Appeals upheld on Thursday the restraining order issued by a Seattle judge on the immigration ban imposed by US President Donald Trump against citizens of seven predominantly Muslim countries. It was a unanimous ruling by the three-man court. Trump, angered by the appellate court's ruling, sent out an all-caps tweet. "SEE YOU IN COURT, THE SECURITY OF OUR NATION IS AT STAKE!" Trump tweeted. Reacting on the appeals court decision, former secretary of state and Democratic presidential candidate Hillary Clinton tweeted: "3-0". A portion of the 9th circuit court's ruling quoted by CNN said: "On one hand, the public has a powerful interest in national security and in the ability of an elected president to enact policies. And on the other, the public also has an interest in free flow of travel, in avoiding separation of families, and in freedom from discrimination. We need not characterize the public interest more definitely than this. The emergency motion for a stay pending appeal is denied." The US justice department filed an appeal before the 9th circuit court on the restraining order issued by Judge James Robart on the immigration ban against citizens of Iraq, Iran, Syria Libya, Somalia, Sudan and Yemen from entering the US for 90 days and all other refugees in the next 120 days. Robart issued the restraining order after state lawyers from Washington and Minnesota question the travel ban. The justice department questioned the authority of the Seattle judge to issue the restraining order. "It contravenes the considered judgment of Congress that the President should have the unreviewable authority to suspend the admission of any class of aliens," the justice department argued. At the White House, Trump told reporters that the appeals court decision was a political one and that he looks forward to arguing his case. "It's a decision that we'll win, in my opinion, very easily," he added. The 9th circuit judges meanwhile rejected the justice department's argument against the restraining order saying "there is no precedent to support this claim of unreviewability, which runs contrary to the fundamental structure of our constitutional democracy." "Although our jurisprudence has long counseled deference to the political branches on matters of immigration and national security, neither the Supreme Court nor our court has ever held that courts lack the authority to review executive action in those arenas for compliance with the Constitution. The states have the legal right to be in court because of injuries to state business and state universities traceable to the executive order," the magistrates ruled.
