  DUBAI - The new UAE bankruptcy law, which was approved by the UAE Cabinet on September 4, is likely to come into effect early next year. The new law paves the way for companies in financial distress to restructure, said Obaid Humaid Al Tayer, minister of state for financial affairs. Here’s your guide to the UAE Bankruptcy Law:   Who is covered under the UAE bankruptcy law? The law applies to merchants and companies, including semi- or fully owned companies by the federal or local government and companies in free zones which do not have provisions to regulate composition procedures or restructuring bankruptcy, and any trade and licensed company. How do you declare bankruptcy in the UAE? The debtor must declare bankruptcy in court, which will issue a notice to all creditors to register their claims. Emirati creditors of a bankrupt merchant must register their claims within 10 days of publication of the notice. Foreign creditors who are non-UAE residents must register their claims within one month of the announcement.  What happens next? The judge of the bankruptcy court will verify the documents submitted by the debtor and will reschedule debts and lodge them according to the court's instructions. A copy of the schedule along with a statement of the amount that the court intends to accept as debt will be sent to every creditor and the bankrupt entity. The creditors could object to the amount stated by the court. The judge supervising the bankrupt merchant or company will decide whether to accept or reject the objection. What is the downside to declaring bankruptcy? Those who are declared as bankrupt will not be able to carry out businesses. They will also not be allowed to run or vote in any election, or become members of the Federal National Council, Municipality Council, chambers of commerce and industry. Bankrupt merchants will be banned from working at the stock markets, trade or be a member or trustee of any company, in addition to many other positions which are banned. The bankrupt merchant cannot leave the country without informing the court. Can individuals with personal loans declare bankruptcy? No. Individuals involved in personal loans cannot announce bankruptcy. Those who take a loan for building a house, buying a car or other related issues are under the country's civil laws. To announce bankruptcy, one must have a business. Bankruptcy applies only to traders and not to civil debtors. What is the punishment for bankruptcy? Punishment for bankruptcy could be up to five years in jail. What if people misuse the law? The UAE has severe punishment for those who claim to be bankrupt and are proven otherwise. Violators face up to five years in prison and fines of up to Dh1 million. Can individuals who declare bankruptcy leave the UAE? The bankrupt merchant cannot leave the country without informing the court.
