Commute can be counted as office hours: UAE law

  The Ministry of Human Resources and Emiratisation (MOHRE) has issued new labour laws including situations where an employee’s commute can be counted as office hours. These new laws defined the working hours as well as the acceptable reasons for the delay to be considered as part of the employee’s work hours including the following: -The travel time from the employee’s residence to the office during bad weather and official announcements by the National Centre of Meteorology such as rains, sandstorms, and floods. -The time spent by the employee in a company-provided transport while encountering traffic or resolving an emergency car breakdown. -The employee and employer have created an express agreement that includes travel time in the employee’s working hours. This is more likely applicable to individuals in the sales department or requires longer travel time. According to Dr. Ibrahim Al Banna, CEO of Dubai-based Ibrahim Al Banna Advocates and Legal Consultants, the commute time from an employee’s residence to the office cannot be considered as working hours if there is no express agreement created with the employer.
