UAE: Court orders man to repay his sister after he seized money intended to buy a property

A woman sued her brother, demanding him to repay her 20,000 Kuwaiti dinars, or Dh240,000, plus 12 percent interest from the date of the claim until payment, legal fees, and Dh50,000 in restitution for the material and moral harm she suffered. The complainant claimed in her lawsuit that while working in Kuwait, she sent her brother a bank transfer for 20,000 Kuwaiti dinars to purchase a property for her, but he failed to do so and kept the money for himself instead. The appellant acknowledged that his sister had sent him money and that he had given the money to another person. The complainant was required to swear before the court that the funds transferred to her brother's account were intended for her to purchase a property and that she did not request that he give them to someone else. According to the court, the appellee acknowledged receiving the bank transfer but asserted that he had given it to another person at his sister's request without offering any supporting documentation. The court ordered the appellee to pay 20,000 Kuwaiti dinars to his sister or its equivalent in UAE dirhams, along with Dh10,000 as compensation, in addition to the fees and expenses, because the court upheld that the appellee had unlawfully seized the money and that the appellant had suffered material harm as a result of not receiving it.
