All employees in the UAE are entitled to break(s) between working hours with no less than one hour in total. Furthermore, no employee may work for more than five hours in a day without taking a break. This mandate follows Article 18 of the Employment Law, which states: “The employee may not work over five consecutive hours without one or more breaks which shall amount in aggregate to not less than one hour, provided that such break(s) shall not be calculated as part of the working hours." According to the provision, an employer must provide its employees with a break(s) in between working hours. It is a breach of the Employment Law if an employer refuses to allow at least one hour of break per day or after five consecutive hours of labor. In the event that the employer fails to follow the law, employees can file a complaint to the Ministry of Human Resources and Emiratisation (MOHRE). If the matters remain unsettled after the complaint, the ministry will refer the case to the court as mentioned in Article 54(2) of the Employment Law.
