Getting an absconding case or labour ban in the UAE can be stressful, but experts say it is often fixable if handled correctly and quickly. With stricter labour and immigration systems in place, authorities are urging residents to understand their rights, responsibilities, and legal options. What does “absconding” mean? Under UAE law, absconding typically happens when an employee is absent from work for more than seven consecutive days without informing their employer. Cases are reported to the Ministry of Human Resources and Emiratisation (MOHRE) or immigration authorities such as the General Directorate of Residency and Foreigners Affairs (GDRFA). Absconding can also apply to visitors who overstay their visas or fail to exit the country within the allowed period. Consequences may include fines, deportation, visa cancellation, and temporary or permanent bans from re-entering the UAE.

Understanding the different bans

According to industry experts, not all bans are the same. Junie Sorsano, co-founder of Trip Expert International, explained the differences: Absconding case: "This is when an employer reports to MOHRE that an employee has left work without notice or has been absent for a prolonged period. Once filed, the employee is considered ‘absconding,’ which can lead to fines, deportation, and work restrictions,” he said. Labour ban: "This prevents a person from working in the UAE for a certain period. It usually happens if a contract is terminated improperly or there is a breach of labour terms.” Lifetime ban: "This is more serious and is usually imposed in cases involving immigration violations, criminal offences, or repeated misuse of visas.”

What should you do immediately?

Experts stress that timing is critical. “If they find themselves in this situation, they should act quickly and carefully,” Sorsano said. He advised the following first steps: • Verify your status through official platforms such as MOHRE or immigration authorities • Contact your employer, as some cases are filed due to misunderstandings • Seek professional or legal assistance • Avoid working illegally while under a ban “Do not ignore the issue. Delays can lead to heavier penalties, including fines or blacklisting,” he added.

How to resolve an absconding case

There are several ways to resolve an absconding report: 1. Employer withdrawal (fastest option) Your employer can request to cancel the report through MOHRE. 2. File a complaint If the case is false, you can challenge it by submitting proof such as attendance records, messages, or medical reports. 3. Voluntary exit If no resolution is possible, you may request legal exit procedures through immigration authorities, which could involve deportation but prevents further penalties.

What about labour bans and lifetime bans?

Solutions depend on the type of ban: • Labour bans may be lifted if disputes are resolved or if the worker qualifies under certain categories • Lifetime bans require legal review and are more complex, with outcomes depending on the case “In my experience, the solution depends on the type of case,” Sorsano said. “Absconding case removal can take a few weeks. Labour bans may take one to three weeks. Lifetime bans vary widely and can take months.”
