An Abu Dhabi citizen sued a hospital for misdiagnosing an injury in his fingers that resulted in intense pain. For bodily, moral, and monetary damages, he requested Dh100,000 from the hospital. The Arab man said he was injured while jogging in March. After experiencing shoulder and muscle aches, he went to the hospital. The doctor diagnosed him with pain in the right shoulder, muscle pain, and swelling. The man was given treatment and granted a 21-day sick leave. His left index finger swelled and became painful, preventing him from working. After visiting several facilities, it was discovered he had a fractured finger and needed immediate care. The complainant pointed out that his health and psychological condition deteriorated due to the misdiagnosis, as the pain worsened and he had to undergo urgent surgery. Due to the hospital's misdiagnosis, he could not work for many weeks, affecting his job benefits. In its defense, the hospital asked that the case be dismissed for not following the procedure as prescribed by Law No. (4) of 2016 regarding medical liability. The hospital lawyer also argued that there wasn't sufficient evidence to pin his client. The Abu Dhabi court dropped the case after hearing from all parties. The judge ruled that medical liability compensation claims can't be submitted without recourse and presentation to medical liability committees, which the complainant didn't undertake.
