The UAE's Ministry of Human Resources and Emiratisation (MoHRE) has reiterated its rules protecting private-sector employees from unfair termination due to workplace grievances. The announcement clarifies that firing an employee for filing legitimate complaints or legal claims is deemed unlawful. In such cases, employers must compensate dismissed employees with an amount determined by the court. Compensation can be calculated based on factors such as job role, harm caused, and length of service, with a maximum cap of three months’ salary. A MOHRE representative explained, “This policy reinforces the UAE’s dedication to a fair and equitable work environment. Employees should feel confident raising legitimate concerns without fear of retribution.” The ministry outlined seven criteria for imposing disciplinary actions, ranging from confidentiality breaches to misuse of authority. Employers must adhere to these guidelines to ensure fairness and transparency. If an amicable resolution cannot be reached, the ministry will escalate the case to a competent court. Courts have the authority to determine the legitimacy of the dismissal and order compensation if the termination is deemed unfair. Employee rights remain intact even after dismissal.
