UAE: Mother accuses daughter of leaving the house after withdrawing Dh85,000

A mother sued her daughter and demanded that she pay her Dh85,000 in addition to paying expenses, fees, and legal interest at a rate of 12 percent from the date the lawsuit was filed until the total amount was paid. In her lawsuit, the mother claimed her daughter had withdrawn Dh85,000 using her bank card before leaving the house. She also included screenshots of the account statements. The court indicated that, according to the law of evidence, the plaintiff must prove his right and the defendant has the right to deny it, and the burden of proving the alleged right is on the one who upholds it, and that the court is not obligated to conduct an investigation that was not requested by the litigants. Any evidence in the case papers did not support the mother's claim, nor did the mother request an investigation to support her claim, according to the court. On the other hand, the daughter disputed the legitimacy of her mother's claim and ultimately decided the case should be dismissed as it is, ordering the mother to cover the costs and fees.
