UAE: Shopper demands Dh17,000 for damaged car in mall parking lot
An Abu Dhabi court dismissed a case in which a woman had brought a lawsuit against a mall for the damage done to her car after she parked it in the parking lot. The woman had filed a complaint against the mall, requesting payment of Dh17,500 in damages, which included Dh12,500 for the cost of fixing her Lexus and Dh5,000 for moral damages. The woman claimed she had parked her car outside the mall's parking lot and was about to go shopping inside when a mall-owned iron ball moved from its position and struck her vehicle. The woman protested to mall management and asked them to fix her car, but they wouldn't agree to a fair resolution. She then reported the damages caused to her car with an agency and took the matter to court with a copy of the report listing all damages caused to her vehicle. She then filed a report detailing all of the damages to her car with an agency and appeared in court along with a copy of the report. However, the Abu Dhabi Family and Civil Administrative Court dismissed her lawsuit, highlighting that her records contained no proof of the retail mall's responsibility. According to the court, the complainant did not request an investigation to establish the element of error. The defendant also contended that the woman was the one who had refused to take her car for repair and that the insurance company for her car had agreed to fix the damages.
