UAE: Woman to pay Dh325,000 after evading car rental charges

An Abu Dhabi woman who rented luxury cars from a rental company has been forced to pay Dh325,000 after she evaded paying the company. A complaint was brought against the woman by the female owner of a car rental company at the Abu Dhabi Civil Court of First Instance. She asked that the woman pay her Dh325,000 in outstanding automobile rental charges, plus legal interest at a rate of 12% from when the action was filed until the payment was made. The owner explained in her lawsuit that she rented multiple cars to the defendant, but the accused began dodging her and refused to pay the financial obligations. The court stated that the contract must be carried out following its terms and in a manner consistent with what is required by good faith and that the court has full authority to interpret the contracts and agreed terms in a way that does not deviate from the apparent meaning of their explicit expressions, and without examining the literal meaning of some words. A report by an expert who the court assigned showed that Dh325,517 was the due amount the defendant owed the complainant under the terms and conditions of the car rental contract. As a result, the judge issued a ruling requiring the defendant to pay the complainant Dh325,517. The woman was also ordered to pay legal interest on the sum adjudicated at a rate of 5% per year from the date the case was registered until full payment was made. BKM/ Expat Media
