Court doubles compensation for injured employee
The Abu Dhabi Court for Family and Civil and Administrative Cases (First Degree) doubled a worker's compensation from Dh50,000 to Dh100,000 when he had work-related injuries. The employee suffered from thoracic vertebrae fractures that needed two surgeries and made walking difficult. According to the documents, the complainant filed a lawsuit and demanded that they give him Dh500,000 in material and moral compensation and 12 percent interest from the date of the lawsuit's filing until full payment. The complainant said he was hurt due to a lack of security and safety procedures, suggesting the company had been found guilty in a criminal verdict. The company filed a case and asked the court to add an insurance company as a third party. The court ruled that it had no jurisdiction over an insurance company. In addition to paying the fees and costs, the court ordered the company to pay the appellant Dh50,000 for the material and moral damages he suffered. The employee appealed the verdict, emphasizing that the amount of compensation ordered by the court was insufficient to cover the losses he suffered. He also emphasized that the medical report put his incapacity at 50 percent of his maximum strength and asked for payment of Dh100,000 with interest. The court ruled that the appellant's injuries warranted more compensation than the Court of First Instance had determined. Aside from the lawsuit costs, the employer must also pay an annual delay interest of 4 percent from the verdict date until complete payment. The compensation has been amended to become Dh100,000.
