White House, lawyers of 2 states told to file respective positions before tribunal issues decision

  WASHINGTON – A federal appeals court rejected an appeal from the White House to allow the immigration ban ordered by President Donald Trump to resume after a Seattle court judge had issued a restraining order against the travel ban. The Ninth Circuit Court of Appeals on Sunday (February 5) ordered the White House and state lawyers of Washington and Minnesota to file their respective positions on the travel ban before the tribunal issues a decision. Both parties have until Monday in the US to submit their written arguments. So for now, the restraining order issued by Seattle judge James Robart remains in effect. Trump earlier banned citizens of Iraq, Iran, Syria Libya, Somalia, Sudan and Yemen from entering the US for 90 days and all other refugees in the next 120 days. He also stopped indefinitely the flow of Syrian refugees to the US. Robart issued last week a restraining order against the travel ban while he considers a lawsuit brought by Washington attorney general Robert Ferguson against Trump's order. Robart also explained that Trump's travel ban affects "residents in areas of employment, education, business, family relations, and freedom to travel." The justice department, however, lodged a strongly-worded plea before the appellate court regarding Robart's restraining order. "(Robart's ruling) contravenes the considered judgment of Congress that the President should have the unreviewable authority to suspend the admission of any class of aliens," the justice department said. The justice department also said "courts are particularly ill-equipped to second-guess the President's prospective judgment about future risks." "Unlike the President, courts do not have access to classified information about the threat posed by terrorist organizations operating in particular nations, the efforts of those organizations to infiltrate the United States, or gaps in the vetting process," the justice department also said.
