The parents of a newborn child filed a lawsuit against the hospital after the baby was born paralyzed. However, the Abu Dhabi court rejected their request for a temporary compensation of Dh100,000. In the lawsuit, the parents claimed compensation and delegated a medical committee to explain the doctor’s mistake, in addition to obligating the hospital to pay the fees and expenses of the lawsuit and lawyer’s fees. The mother said that she agreed to have a cesarean delivery. She was then transferred to the delivery room, but the doctor did not attend. She also confirmed that she was the one who asked to perform a cesarean delivery and to pay all the costs, but the supervising doctor still performed a normal delivery, which caused paralysis to the newborn. The court indicated that according to the report issued by the Medical Liability Committee, the mother of the child filed a complaint before the committee against the hospital. The report, however, did not indicate that a medical error had been committed by the hospital. The court added that the report of the committee was still valid, thus rejecting the lawsuit and the parents’ plea for compensation.
