Firm to pay Dh44,000 for 8,000 chickens’ death

A company was ordered by the Al Ain Court of First Instance to reimburse another company Dh44,000 after the latter killed 8,000 chickens. According to reports, the complainant company and the appellant company agreed for the appellant to supply one-day-old chicks for Dh2.60 each chick in exchange for the appellant's commitment to providing coops and all other necessary equipment for growing the chicks. The appellee agreed to purchase the chicken amounts after 30 days for Dh7.50 per kilogram with a Dh500,000 fine. The appellant did not purchase the chicken, which led to the death of more than 8,000 chickens, the complainant company confirmed. It asked the court to order the appellant to pay Dh499,000, to return the Dh70,000 guarantee check, in addition to Dh500,000 for the agreed-upon compensation amount, fees, and costs. The appellant company refused to buy the chicken after it was more than 50 days old, according to the accounting expert whose report was requested by the judge. The expert noted that the two parties had engaged in numerous prior transactions in which the appellant was committed to buying live, mature chicken. As a result, the appellant company sold the chickens to other businesses for Dh167,000. The expert also confirmed that the appellant company owed the complainant Dh44,000. As a result, the court ordered the appellant to pay the complainant company plus legal interest of 2 percent yearly and to return the guarantee check, failing which the court declared it void.
